It gives you the opportunity to access to the chaowapawa.com website or the mobile application/app to access you in this online e-commerce platform and setting the terms and conditions for you. If you use this website as a register or a guest user you are agreed to be abide by this policy. You are requested to read this policy carefully, if you are not interested to abide by this terms and conditions, you should not subscribe to or use the ChaowaPawa website or our services. ChaowaPawa reserves the right to change or modify or edit or remove these terms and conditions at any time without any notification.

1. In these terms and conditions “user” means the end user and “we”, “our” and “us” shall mean “chaowapawa.com”.
2. Accepting this policy will mean you are also accepting and agreeing to abide by the other policies of ChaowaPawa e.g. Privacy Policy of ChaowaPawa are available in the website to be amended time to time.
3. This terms and conditions is considered an electronic record in terms of Information and Communication Technology Act 2006 (তথ্য ও যোগাযোগ প্রযুক্তি আইন, ২০০৬) of the Government of Bangladesh and will be treated as form of valid and binding agreement between the user and the website that does not require any physical or electronic/ digital signature.
4. There are some other links of other websites which are not controlled by ChaowaPawa and ChaowaPawa has no control over the linked sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
5. You can terminate this agreement with ChaowaPawa by closing your account and/or not using/ visiting this website if these options are available to you. Until this agreement is terminated by either you or ChaowaPawa it shall be treated as applicable to you.  ChaowaPawa reserves the right to terminate your account at any time or as and when necessary without any notification to you.
6. You are responsible to maintain the confidentiality of your user name, password, accounts detail and related private information. ChaowPawa is not responsible for any losses or damages of your confidentiality regarding your accounts. Please ensure your detail information provided to us is correct and complete all time.
7. The minor (those who are under the age of 18 years) are not eligible to register as a user of ChaowaPawa, use the website and make any transaction. The parents/ legal representative/ guardian of the minor can place order and make transaction on behalf of the minor. ChaowaPawa reserves the right to terminate minor’s membership and / or refuse to provide you with access to the website as soon as ChaowaPawa get notified.
8. Acknowledging the terms and conditions or transacting on the website, the user conclusively declares and undertakes that s/he is of legal age i.e. 18 years or older and capable of entering into a binding contract and such usage shall be deemed to form a contract between the website and such user to the extent permissible under applicable laws.

By accessing chaowapawa.com website, liking ChaowaPawa facebook account and/ or page, following/ liking other social media pages, contacting us via phone or email, you consent to receive communication from ChaowaPawa. These authorizes ChaowaPawa to communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the website and/or your order placed on the Website.  Additionally, any disclosures posted on the site, or sent to you by email fulfill the legal obligation of communication made in writing.
10. You can access to the ChaowaPawa website either by opening an account through registration option or simply as guest user. The register users will enjoy access to different section of the website and different benefits and promotions as set forth by ChaowaPawa for register user time to time whereas the guest user will not access those.
11. You may create an   account with the ChaowaPawa website by registering with this which will require a valid email address and/ or Bangladeshi mobile number and other mandatory basic information about you in the prescribed online registration form.
12. You have right to terminate or suspend your registered account and/ or membership anytime if you have reasonable ground to believe that the information you provided in in this website is untrue, inaccurate, not current or incomplete, or not in accordance with this terms and conditions and privacy policy.
13. Because of the routine and/ or unexpected website maintenance and for other reason, the website may not be functioning fully or at it’s full scope without prior notice. During this period you may not be able to access to the website and under no circumstance ChaowaPawa will not be held liable for any damage/ losses or claimed arising for such inaccessibility to the users and the users expressly waive any claims against ChaowaPawa in this regard.
14. There is no cost for creating membership and maintenance of membership with ChaowaPawa, this is completely free. All eligible individual are sincerely encouraged to register with ChaowaPawa to be member to access additional benefits offered by ChaowaPawa to its registered users time to time. However, ChaowaPawa reserves the right to introduce, increase/ modify membership and/ or membership maintenance and other service fees as and when required by its own discretion. Any such changes will be posted on the website and will automatically come effective upon posting on the website. The government of Bangladesh may impose any membership and/ or maintenance fees/ charge anytime and users will be abided by any government decision taken any time without notice.
15. All the data and information that include but not limited to logo, mission statement, policies, branding materials, content, software, slogan, and services on the ChaowaPawa website are the property of ChaowaPawa, its companies, firms, sister concerns, affiliates and/or third party licensors. Under no circumstance nobody is allowed to copy, republish, reproduce, install, transmit and post, store or distribute without prior written permission from ChaowaPawa.
16. The ChaowaPawa logo that includes the marketing slogan attached is in the process of Trademark registration with government of Bangladesh and no one is allowed to use ChaowaPawa logo and it’s marketing slogan/ tag anywhere else without prior written approval from ChaowaPawa.
17. Anyone including the user are not allowed to  use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, data mining, or similar data gathering and extraction tools to access, acquire, copy or monitor any portion of the website or any content, or in any way reproduce or avoid the navigational structure or presentation of the website or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the website. ChaowaPawa reserves all right to bar any such activity anytime without any notice.
18. ChaowaPawa uses cookies in it’s website and other contents. If you leave a comment on ChaowaPawa website you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.
19. If you visit ChaowaPawa login page, ChaowaPawa will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

Photo/ images of the products in the website are for and by reference only and actual product may vary from the corresponding photo/ image shown in the website. The website disclaims any liabilities arising out of any inconsistencies to this end to the fullest extent permitted by law.
23. We consider your order as “expression of interest” to procure product(s)/ service(s) made available on ChaowaPawa website agreeing with the terms and conditions articulated for respective product/ services. Upon placing an order to purchase product(s)/ service(s) from us, you will receive an e-mail and/or SMS to your mobile phone number confirming receipt of your order and/or containing the details of your order “Confirmation of Order and/ or SMS”. The Order Confirmation E-mail and/or SMS will be considered as the acknowledgement that we have received your order, but does not confirm acceptance of your expression of interest to procure the product(s) or service(s) ordered; that when we send the Order Confirmation E-mail and/or SMS a contract called an “agreement to sell” is concluded in accordance with Section 4(3) of the Sale of Goods Act, 1930 i.e. the transfer of the property in the goods is to take place at a future time when the product(s) is/are delivered to your designated address. We only accept your expression of interest, and the above “agreement to sell” becomes a contract of sale for product(s) ordered by you in accordance with Section 4(4) of the Sale of Goods Act, 1930, when the product(s) is/are delivered to your designated address and at that time the property in the goods is transferred from us to you.
24. You can cancel your order as whole or partly at no cost any time before the goods are delivered to you at your shipping address.
25. ChaowaPawa does not grow, manufacture or produce any product by itself but sources from reliable and trustworthy merchants, producers, distributors, suppliers, importers, and manufacturers. Despite of our effort to provide the best details, it does not warrant that product descriptions or other content of any ChaowaPawa product is accurate, complete, reliable, current, or error-free. If any product is not as described in the website, you will have sole authority to get refund if you want.
26. ChaowaPawa presents the full retail price listed with the product(s) or service(s) the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The list price or suggested price is a comparative price estimate and may or may not represent the usual price in every area on any particular day.
27. ChaowaPawa takes every effort to offer you the best price. However, you may find a few product available on the website may seem by error/ mistake. If ChaowaPawa notices or is notified any retail price of an item sold by ChaowaPawa is higher than the price stated by ChaowaPawa, ChaowaPawa will, either contact you for your advice before shipping or cancel your order and notify you of such cancellation. On the other hand, if the stated price on the product is lower, ChaowaPawa will, either refund the amount or replace the product according to your choice based on the availability when acknowledged. You may decide to adjust the refundable amount with your next order with ChaowaPawa.
28. You may return any product during the time of delivery, or within 7 days of delivery at it’s same condition when delivered by your own cost if you like so without producing decide to do so.
29. ChaowaPawa aims to fulfil it’s commitment (delivery etc.). In case, ChaowaPawa fails to meet it’s commitment, you will receive notification from ChaowaPawa within 24 hours via email/ phone/ SMS. If the service that ChaowaPawa fails to meet requires any refund, it will be made within 10 days after our acknowledgement. Refund requests will be processed if ChaowaPawa unable to serve with any product, you return any product from a paid order, you cancel a paid order before it has been dispatched.
    The refund amount/ balance will be sent to your original payment source within 10 days of refund request. You may decide to adjust the refund amount with your next order with ChaowaPawa.
30. You can use ChaowaPawa Software/ Application/ App as an user that will enable you to access the services as provided or offered by ChaowaPawa time to time within this terms and conditions. Under no circumstance you are allowed to include any part of ChaowaPawa software/ application/ app into your own programs or compile/ merge any part of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the software / application/ app or otherwise assign any rights to the ChaowaPawa software/ application/ app in whole or in part. No one is allowed to use ChaowaPawa software/ application/ app for any illegal intent/purpose. ChaowaPawa may cease providing any ChaowaPawa software/ application/ app to you and we may terminate your right to use any ChaowaPawa software / application/ app at any time if so required at ChaowaPawa’s sole discretion. Failure to comply with any of these terms and condition will result automatic termination of your rights to access/ use ChaowaPawa software/ application/ app immediately.
31. It is not permitted to support or authorize any other person to copy, adjust, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the ChaowaPawa software/ application/ app, whether in whole or in part, or produce any copied works from or of the ChaowaPawa software/ application/ app.
32. ChaowaPawa software/ application/ app will offer periodic automatic or manual updates at any time without any notice to you.
33. All software used in any ChaowaPawa service is the property of ChaowaPawa and/or its affiliates or its software suppliers and protected by laws of Bangladesh including but not limited to any other applicable copyright laws.
